Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Tracklet mobile application (the "App") operated by Tracklet ("we", "our", or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Use of the App

You may use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates any applicable local, national, or international law or regulation.
• Attempt to gain unauthorised access to any part of the App or its related systems.
• Reverse-engineer, decompile, or disassemble any portion of the App.
• Use the App to track individuals without their knowledge or consent.
• Interfere with or disrupt the integrity or performance of the App or its servers.

2. Account Registration

To use the App you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.

3. Hardware and Devices

Tracklet tags ("Tags") are physical hardware devices sold separately. We do not guarantee uninterrupted detection or coverage. Tag visibility depends on Bluetooth range, device proximity, and the availability of other Tracklet users in the vicinity.

4. Intellectual Property

All content, trademarks, logos, and software within the App are the property of Tracklet or its licensors. Nothing in these Terms grants you any right to use our intellectual property without our prior written consent.

5. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

6. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without any warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the App is at your sole risk.

7. Limitation of Liability

To the maximum extent permitted by law, Tracklet shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid us in the twelve months preceding the claim.

8. Termination

We may suspend or terminate your access to the App at any time, with or without cause or notice, including for breach of these Terms. Upon termination, your right to use the App will immediately cease.

9. Changes to These Terms

We may revise these Terms from time to time. Updated Terms will be posted on this page with a revised "last updated" date. Continued use of the App after changes constitutes your acceptance of the new Terms.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
